A student came to us after their application to restore their status as a student in Canada had been refused. The refusal pointed to two semesters in which the student had taken unauthorized breaks in their studies, and it left them uncertain about whether anything could still be done to save their standing in Canada.
At Verge Immigration Services Inc., our RCIC, Mr. Jatinder Singh, reviewed the full file and determined that the officer had fettered their discretion in refusing the application, rather than properly weighing the student's individual circumstances. Instead of starting over with a fresh application, we identified a stronger path forward.
We requested that IRCC reconsider the refused application, setting out clearly why the original decision should not stand and addressing the concerns raised in the refusal. Following our submission, IRCC reopened the application and subsequently approved it.

This outcome restored the student's ability to continue their studies in Canada without having to leave and reapply from outside the country. A refusal is not always the end of the road. Where an officer has not properly exercised their discretion, a well argued request for reconsideration can reopen a file that first appeared closed.
